I have to find the pose i referenced because I've started this idea a million times (usually with Superman rather than Batman) and it never quite got out of sketch stages, so I'd really like to credit the reference shot for working so perfectly.

Very cool! I see nothing emo about this. Batman is far from a whiny pathetic emo kid. He spends every night beating up psychopaths,the guy has a right to be tired from time to time. But the war goes on.
I love the mood of this piece! It's not one you normally find in depictions of Batman. And your shading techniques call to mind a comic book illustration to me, which is a nice touch, especially considering the subject.
My only criticism is that I get the feeling that he's supposed to be sitting on a bench or table or something of the sort, but whatever he's sitting on doesn't feel much like either; his thighs don't seem to be resting on the aforementioned sitting place, but rather sort of hovering over them. This gives the illusion that (what I'm assuming is supposed to be the level top surface of) the table isn't flat, but rather is slanted towards his feet and he's not really touching it at all. I'd suggest trying to work with the shading of his cape to make that surface feel more level, if it's something you want to mess with. Other than that though, very nice work!
